End User License Agreement (EULA)

 

1. Acceptance of Terms

 

By accessing or using the PassRACGP flashcards, you agree to be bound by the terms of this End User License Agreement (EULA). If you do not agree to these terms, you must not access or use the flashcards.

 

2. Licence Grant

 

PassRACGP grants you a non-exclusive, non-transferable licence to use the flashcards for your personal, non-commercial use. You may download and access the flashcards on your personal devices for the purpose of study and examination preparation.

 

3. Restrictions on Use

 

You agree to the following restrictions regarding the use of the flashcards:

 

• You may not share, distribute, or sell the flashcards to others in any form, including but not limited to copying, uploading to websites, or distributing via email or social media.
 

• You may not use the flashcards for any commercial purpose or for the benefit of any third party.

 

4. Ownership

 

All intellectual property rights in the flashcards, including but not limited to copyright, are owned by PassRACGP. You do not acquire any ownership rights to the flashcards through this EULA.

 

5. Enforcement and Penalties

 

Any unauthorised sale, distribution, or reproduction of PassRACGP flashcards will be considered a breach of this agreement. In the event of such a breach, PassRACGP reserves the right to take legal action to enforce this agreement. The offending party may be liable for damages, including but not limited to, loss of revenue and legal fees incurred by PassRACGP.

 

6. Termination

 

This EULA is effective until terminated. PassRACGP may terminate this agreement at any time if you violate any of its terms. Upon termination, you must cease all use of the flashcards and destroy any copies in your possession.

 

7. Limitation of Liability

 

To the maximum extent permitted by law, PassRACGP shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use of or inability to use the flashcards.

 

8. Governing Law

 

This EULA shall be governed by and construed in accordance with the laws of Australia, without regard to its conflict of law principles. Any legal action or proceeding arising under this EULA will be brought exclusively in the courts located in QLD, Australia.
